Terms of Service
These Terms of Service govern your use of the Train My Game platform. By creating an account or using the platform, you agree to be bound by these terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using the Train My Game platform ("Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Platform.
These terms constitute a legally binding agreement between you and Train My Game Pty Ltd ("TMG", "we", "us", "our"), an Australian company based in Adelaide, South Australia.
2. Use of the Platform
The Platform is intended for use by sports coaches and their athletes for the purpose of training program management and athlete development.
- Coaches may create accounts, build training programs, add athletes, track performance, and collect payments through the Platform.
- Athletes access training programs assigned by their coach, log their sessions, and track progress. Where a coach charges for access, an athlete or their parent subscribes to that coach on a recurring basis via a secure web link sent by the coach.
- You must be at least 18 years of age to create a coach account. Athletes under 18 may use the Platform only with appropriate parental or guardian consent obtained by their coach.
- You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms.
3. Accounts
To use the Platform as a coach, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access to your account
- Take responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or harmful purposes.
4. Fees & Billing
Train My Game does not charge coaches a subscription fee. There is no monthly or annual charge for a coach account at any tier.
TMG earns revenue solely as a percentage-based platform fee deducted from payments athletes make to their coach through the Platform. The applicable percentage is determined by the coach's active athlete count — see our Coach Terms for the full fee schedule.
- All amounts are in Australian Dollars (AUD) unless otherwise stated.
- Athletes subscribe to a coach on a recurring weekly basis. Subscriptions continue until cancelled, and are not tied to any individual training program.
- We may change the fee schedule with at least 30 days' written notice.
A coach may move an athlete between the membership tiers they offer. A change of this kind always takes effect at the start of the athlete's next billing period — never part-way through a period already paid for — and the athlete keeps everything their current membership includes until that date. No part of a paid period is forfeited, and no period is charged twice.
If the change increases the amount payable, or reduces the number of sessions the membership includes, we will email the athlete and their parent or guardian at least 7 days before it takes effect, stating what is changing and the date it applies. If you do not wish to continue on the new membership, you may cancel before that date and the new amount will not be charged — contact your coach, or email us at admin@trainmygame.com.au. Any other change takes effect at the start of the next billing period.
Payments are processed by Stripe and are subject to the Stripe Services Agreement and Stripe's Privacy Policy. Payments from athletes are collected on the coach's own Stripe account — see Coach Terms section 2.
Payments are not made through the mobile application. Athlete subscriptions are set up and paid for on the web, via a link the coach sends. The mobile app does not display prices, accept payment, or link to payment pages.
5. Athlete Data Responsibility
Coaches are responsible for obtaining appropriate consent before adding any athlete to the Platform, including written parental or guardian consent for athletes under 18. By adding an athlete, you confirm you have obtained this consent.
Coaches must handle athlete data in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth) and Australian Privacy Principles. Coaches must not use athlete data for any purpose outside the scope of their coaching relationship with that athlete.
6. Intellectual Property
All intellectual property rights in the Platform — including its software, design, features, and documentation — are owned by or licensed to Train My Game Pty Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purposes only.
Content you upload or create on the Platform (such as training programs, drills, and session notes) remains your property. By uploading content, you grant TMG a limited licence to store, display, and process that content solely to provide the Platform services.
You must not copy, modify, reverse engineer, or create derivative works of the Platform without our prior written consent.
7. Limitation of Liability
To the maximum extent permitted by law, TMG is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total platform fees earned by TMG from your account in the three months preceding the claim, or one hundred Australian dollars (AUD $100), whichever is greater.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
8. Termination
You may terminate your account at any time by contacting us at admin@trainmygame.com.au or via account settings.
We may suspend or terminate your access to the Platform immediately, without prior notice, if you materially breach these Terms, engage in fraudulent activity, or if we reasonably believe your continued use poses a risk to other users or to the Platform.
Upon termination, your right to use the Platform ceases immediately. Data deletion following termination is handled in accordance with our Privacy Policy.
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before the changes take effect. Continued use of the Platform after notification constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Platform before the changes take effect.
10. AI-Generated Content
The Platform uses artificial intelligence to generate training programs, game analysis, statistics, player event detection, and training insights.
AI-generated training programs are drafts intended for review and editing by a qualified coach before assignment to any athlete. They are generated from limited information and do not account for an athlete's injury history, medical conditions, physical maturity, or individual circumstances. A coach must review and take responsibility for any program before assigning it. TMG does not supervise training and is not responsible for injury or harm arising from any program, whether AI-generated or coach-authored.
AI-generated analysis, statistics and event detection are indicative only and may contain errors. They should not be relied upon as an accurate or complete record of any game, session, or performance.
Train My Game Pty Ltd makes no warranty as to the accuracy, completeness, or fitness for purpose of any AI-generated output.
11. Dispute Resolution
Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days from the date one party notifies the other in writing of the dispute. If resolution cannot be reached within that period, either party may pursue their legal remedies.
12. Governing Law
These Terms are governed by the laws of South Australia, Australia. Any disputes arising from or relating to these Terms will be subject to the exclusive jurisdiction of the courts of South Australia.
