Terms of Service
These Terms of Service govern your use of the Train My Game platform. By creating an account or using the platform, you agree to be bound by these terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using the Train My Game platform ("Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use the Platform.
These terms constitute a legally binding agreement between you and Train My Game Pty Ltd ("TMG", "we", "us", "our"), an Australian company based in Adelaide, South Australia.
2. Use of the Platform
The Platform is intended for use by sports coaches and their players for the purpose of training program management and player development.
- Coaches may create accounts, build training programs, add players, track performance, and collect payments through the Platform.
- Players may access their assigned training programs, log sessions, and track their progress through invitation links provided by their coach.
- You must be at least 18 years of age to create a coach account. Players under 18 may use the Platform only with appropriate parental or guardian consent obtained by their coach.
- You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms.
3. Accounts
To use the Platform as a coach, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised access to your account
- Take responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent or harmful purposes.
4. Subscriptions & Billing
Coach accounts are offered on a subscription basis. By subscribing, you agree to the following:
- Starter tier coaches pay no monthly subscription fee. Growth, Pro, and Elite tier subscriptions are billed monthly via Stripe, commencing 30 days after your first successful player payment.
- All fees are in Australian Dollars (AUD) unless otherwise stated
- You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
- We reserve the right to change subscription pricing with at least 30 days' written notice
- Platform transaction fees apply to payments collected through the Platform — see our Coach Terms for the full fee schedule
Payments are processed by Stripe and subject to Stripe's Stripe Services Agreement and Privacy Policy.
5. Player Data Responsibility
Coaches are responsible for obtaining appropriate consent before adding any player to the Platform, including written parental or guardian consent for players under 18. By adding a player, you confirm you have obtained this consent.
Coaches must handle player data in accordance with applicable privacy laws, including the Privacy Act 1988 (Cth) and Australian Privacy Principles. Coaches must not use player data for any purpose outside the scope of their coaching relationship with that player.
6. Intellectual Property
All intellectual property rights in the Platform — including its software, design, features, and documentation — are owned by or licensed to Train My Game Pty Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Platform for its intended purposes only.
Content you upload or create on the Platform (such as training programs, drills, and session notes) remains your property. By uploading content, you grant TMG a limited licence to store, display, and process that content solely to provide the Platform services.
You must not copy, modify, reverse engineer, or create derivative works of the Platform without our prior written consent.
7. Limitation of Liability
To the maximum extent permitted by law, TMG is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
Our total liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the total subscription fees paid by you in the three months preceding the claim.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under applicable law.
8. Termination
You may terminate your account at any time by contacting us at admin@trainmygame.com.au or via account settings.
We may suspend or terminate your access to the Platform immediately, without prior notice, if you materially breach these Terms, engage in fraudulent activity, or if we reasonably believe your continued use poses a risk to other users or to the Platform.
Upon termination, your right to use the Platform ceases immediately. Data deletion following termination is handled in accordance with our Privacy Policy.
9. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before the changes take effect. Continued use of the Platform after notification constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Platform before the changes take effect.
11. AI-Generated Content
The Platform uses artificial intelligence to generate game analysis, statistics, player event detection, and training insights. AI-generated content is indicative only and may contain errors or inaccuracies. It should not be relied upon as an accurate or complete record of any game, session, or player performance. Users accept full responsibility for any decisions made based on AI-generated content. Train My Game Pty Ltd makes no warranty as to the accuracy, completeness, or fitness for purpose of any AI-generated output.
12. Dispute Resolution
Before initiating any formal legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of 30 days from the date one party notifies the other in writing of the dispute. If resolution cannot be reached within that period, either party may pursue their legal remedies.
13. Governing Law
These Terms are governed by the laws of South Australia, Australia. Any disputes arising from or relating to these Terms will be subject to the exclusive jurisdiction of the courts of South Australia.
